Terms of Service
1. Agreement
These Terms are a contract between you and Avery Intelligence Inc (“Avery Intelligence,” “we,” “us”) for Fake News Party at fakenews.party. By using the site you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
2. The service
Fake News Party is a live multiplayer party game. A host runs the show on a screen. Players join on phones, write fictional “lies” about real headlines, and vote. Chip McDoodle is an AI game-show host. The site is entertainment, not a news organization.
3. Eligibility
You must be at least 13 years old to play. You must be at least 18 years old to create a paying host account or buy game packs. You are responsible for compliance with the laws where you use the service.
4. Host accounts
Hosts sign up with an email and password (Firebase Authentication). You are responsible for your account. We may suspend accounts that break these Terms or abuse the service.
5. Game packs and refunds
Packs are one-time digital credits to host games. They are not a subscription. Each purchased game credit must be used within 1 year of the purchase date. Unused credits expire after 1 year and are not refundable after they expire. We do not store your full card number; Stripe processes payment.
Unused packs may be refunded within 14 days of purchase if you email [email protected] from the host email, unless the credits have already been used or have expired. Starting a hosted game uses a credit. Once a credit is used, that credit is not refundable. If you are in the European Economic Area or United Kingdom, asking us to start a game after purchase is your request that we begin digital performance, and you lose the statutory withdrawal right for those used credits.
Hosts who buy packs must be 18 or older.
6. Player content
Lies, nicknames, avatars, votes, and emoji reactions are your content. You grant Avery Intelligence a worldwide, non-exclusive, royalty-free license to host, display, and transmit that content in the live room and on the host screen for the purpose of running the show. You represent that you have the right to submit it and that it does not violate the law or these Terms.
We may remove content or end a room that is illegal, harassing, or otherwise objectionable. We do not pre-screen every lie. You may see content from other players that you dislike. Report abuse to [email protected].
7. Acceptable use
You will not: break the law; submit sexual content involving minors; dox or harass anyone; attempt to disrupt the service; scrape the news bank for republication as a competing product; or use the service to train a public generative model on other players’ lies. Automated access other than ordinary play is not allowed.
8. AI, headlines, and images
Chip McDoodle is an artificial intelligence system. Voice lines are machine-generated. Headlines used in the game come from public news sources and are presented for entertainment. Player lies are fiction. Photographs on /news marked “Fake image” are AI-generated illustrations, not news photographs. Do not treat the game, Chip, or /news as journalism, advice, or a statement of fact about current events beyond the sourced headline itself.
9. Not gambling
Points, “payouts,” jackpots, and casino-style sound are theatrical. There is no wager, no cash prize, and no conversion of points or credits into money.
10. Intellectual property
The Fake News Party name, show design, Chip McDoodle character, software, and baked audio (other than third-party music credited on /credits) are owned by Avery Intelligence Inc or its licensors. We grant you a limited, revocable license to use the service for personal or social play.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVERY INTELLIGENCE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Headlines, AI speech, and player content may be wrong, offensive, or unavailable.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVERY INTELLIGENCE AND ITS OFFICERS AND EMPLOYEES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR GAME PACKS IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU PAID NOTHING.
Some places do not allow these limits. In those places, the limit is the minimum required by law. Nothing here limits liability that cannot be limited, including certain consumer rights.
13. Indemnity
You will defend and indemnify Avery Intelligence Inc against claims arising from your content or your breach of these Terms.
14. Governing law
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Courts in Santa Clara County, California have exclusive venue, except that you may bring qualifying consumer claims in your county of residence where the law requires it.
15. Changes
We may update these Terms by posting a new version on this page. Continued use after the date above is acceptance of the new Terms.
